Unlike most other states, New York hasn't adopted a no-fault approach to divorce. You need to allege grounds for divorce, such as infidelity, abuse or abandonment. In most cases, people understand that the stated grounds for divorce is basically alleged as a legal formality, and any legal grounds with some basis in fact will usually do. Once in a while, however, someone will dispute the grounds for divorce, and the spouse filing for divorce needs to be prepared to prove the grounds alleged if contested.
Because living apart for a year or more is legal grounds for divorce in New York, many people find it convenient to negotiate and execute a separation agreement. This will avoid the need to get into allegations of grounds while covering substantially the same issues as a divorce decree:
- Child custody and visitation
- Child support
- Alimony or spousal maintenance
- Marital property division
After a year of life under the separation agreement, the document can serve as the basis for final divorce stipulations. Alternatively, any problems that come up in the performance of the separation agreement can inform negotiated revisions to support or custody arrangements, or define the issues for litigation in family court.
